1. Acknowledgment of Risks
I, the undersigned participant (or parent/legal guardian of the participant), understand that participation in strength and conditioning training, private lessons, group classes, camps, clinics, and other athletic activities (“Activities”) with FitDips Strength & Conditioning involves inherent risks of injury, illness, permanent disability, or death. These risks include but are not limited to muscle strains, sprains, fractures, concussions, overexertion, and other serious physical injuries. I acknowledge and voluntarily assume all risks associated with participation, whether known or unknown, including those that may arise from the negligence of FitDips Strength & Conditioning, its staff, or affiliates.
2. Release and Waiver of Liability
In consideration for being allowed to participate in the Activities, I hereby release, waive, and discharge FitDips Strength & Conditioning LLC, its owners, coaches, directors, officers, employees, volunteers, and agents (“Releasees”) from any and all liability, claims, demands, or causes of action that may arise out of or relate to any injury, illness, disability, or death occurring during or resulting from participation in the Activities, whether caused by negligence or otherwise.
3. Medical Authorization
I authorize FitDips Strength & Conditioning staff to provide or obtain emergency medical treatment deemed necessary for the participant and agree to be fully responsible for any medical expenses incurred as a result of such treatment. I understand that FitDips staff may not be certified medical professionals and that medical care may be provided by outside emergency personnel.
4. Photo and Video Release
I grant FitDips Strength & Conditioning permission to use photographs and videos taken during Activities for promotional, educational, or marketing purposes in print and digital media. I waive any right to compensation or ownership of such materials.
5. Conduct and Sportsmanship
I understand that all participants are expected to act respectfully, follow safety protocols, and comply with coach instructions at all times. Disruptive or unsafe behavior may result in removal from the program without refund.
6. Indemnification
I agree to indemnify, defend, and hold harmless the Releasees from any and all claims, damages, liabilities, costs, or expenses (including reasonable attorney’s fees) that may arise from or be related to my or my child’s participation in the Activities.
7. Governing Law
This Waiver and Release shall be governed by and construed in accordance with the laws of the State of California. If any provision is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
